Coldry Patent Advances to Final Stage in USA

Environmental Clean Technologies Limited (ASX:ESI) is pleased to announce the advancement of its Coldry Patent Application in the USA.

ECT, through its Patent attorney Davies Collison Cave and their USA associate, has been issued with a ‘Notice of Allowance’ for its Application to register the Coldry Intellectual Property (IP) as a Patent.

ECT Business Manager Ashley Moore said, “This is the final step prior to the issuance of our Patent in the US. Following the payment of the required fees, we expect our ‘US’ Patent will be issued within the normal processing timeframe of three months, strengthening Intellectual Property protection in this significant market.”

This development follows a series of engagements with US examiners over the past few years to move the Patent Application forward. Various ‘prior art’ documents referenced during the examination process were compared with the Coldry technology to establish its unique features and confirm its ‘novelty’ and patentability.

ECT Chief Executive Kos Galtos added, “We’re very pleased the Coldry technology has met all the criteria required to allow the issuing of the Patent in the USA. This builds nicely on the progress made with the issue of our Patent in China last August and we look forward to the advancement of our Patent Application in other key jurisdictions, including Europe, India and Australia.

“Strategically, patent protection is an important plank in our IP strategy, along with well structured agreements and careful levels of disclosure. Tactically, there is no better protection for first-of-kind technology than actually getting it to market, establishing its commercial bona fides in the real world then continuing to innovate.”

At present underpinning ECT’s high level IP strategy is our commercialisation focus on the Coldry technology in Victoria’s Latrobe Valley, with work ongoing to progress to the ‘Design for Tender’ (DFT) for the deployment of a 2 million tonne per year plant by 2014.

The US Patent, in concert with the DFT for the Victorian project will provide a sound basis for future discussions around the deployment of Coldry in the US and other markets.
